Finansinspektionen ålägger Ålandsbanken Abp att betala en ordningsavgift för försummelser vid rapporteringen av derivatkontrakt

Enligt Finansinspektionen har Ålandsbanken inte med tillräcklig omsorg kontrollerat att rapporteringen av derivatkontrakten fungerar i enlighet med tillämpligt regelverk. Bristerna i rapporteringen påverkade inte Ålandsbanken eller dess kunder, och Finansinspektionens beslut kräver inga åtgärder från kundernas sida.

Finansinspektionen har påfört Ålandsbanken en ordningsavgift på 60 000 euro. Grunden för ordningsavgiften är brister i Ålandsbankens rapportering av derivatkontrakt som ingåtts under perioden 2016–2021. Bristerna gäller skyldigheten att rapportera alla derivatkontrakt till ett transaktionsregister i enlighet med EU:s förordning European Market Infrastructure Regulation, EMIR. För den aktuella rapporteringen hade banken anlitat en clearingagent som skulle ombesörja rapporteringen för bankens räkning. Clearingagenten har dock inte rapporterat alla derivatkontrakt till transaktionsregistret. Bristerna korrigerades när banken blev medveten om dem.
